ELEMENTOS DE LEI E JUSTIÇA PRESENTES NOS MITOS E TRAGÉDIAS

Resumo

O presente ensaio trata sobre os elementos de Lei e de Justiça presentes nos mitos e tragédias da Grécia Arcaica. O conflito que se faz presente, entre Lei Natural e Lei Positiva, entre as mais diversas espécies de Justiça invocadas tanto pelos heróis das Tragédias, como que narradas nos mitos, geram a necessidade de compreendermos o que são, em primeiro lugar, os mitos e as tragédias. Ato contínuo, há a busca pela identificação dos elementos de Lei e de Justiça presentes nos mitos e nas tragédias. Dos mais famosos elementos jurídicos presentes nas tragédias, temos a discussão que se deu entre Antígona e Creonte acerca da necessidade de se cumprir ou a Lei Natural ou a Lei dos Homens. Nos mitos, temos a presença de diversas noções de Justiça. Há, todavia, uma imprecisão sobre o que se entendia por Justiça na Grécia Arcaica e os mitos não são capazes o suficiente de esclarecer a que Justiça está-se referindo, ao contrário do conceito de Lei (Lei Natural ou Eterna e Lei dos Homens ou da Cidade), que estava bastante claro a partir dos elementos linguísticos presentes na literatura da Grega dos Séculos V e IV a.C.   Palavras-Chave: Mito; Tragédia; Lei Natural; Direito; Justiça.   Abstract:   This essay deals with the elements of law and justice present in myths and tragedies of Archaic Greece. The conflict is present between Natural Law and Positive Law; among the most diverse species of Justice invoked by both the heroes of the tragedies, the myths narrated generates the obligation to understand what they are. First, the myths and tragedies needs a deep interpretation. Immediately, thereafter, there is a search by identifying the elements of law and justice present in myths and tragedies. The most famous cool elements contained in the tragedies we have the discussion between Antigone and Creon about the need to comply or Natural Law or the Law of Men. In myths, we have the presence of various notions of justice. There is, however, a lack of precision about what is meant by justice in Archaic Greece and myths are not capable enough to clarify that Justice is referring, unlike the concept of Law (Natural Law or Eternal Law and Men or City), it was quite clear from the linguistic elements present in Greek literature of the fifth and fourth centuries B.C.   Keywords: Myth; Tragedy; Natural Law; Law; Justice.   JACCOTTET, Gustavo. “Elementos da Lei e Justiça presentes nos Mitos e Tragédias”.
