O DEBATE ENTRE HERBERT L. A. HART E RONALD DWORKIN

Resumo

Neste artigo analisarei a concepção de direito em Herbert Hart e em Ronald Dworkin. Procurarei mostrar algumas diferenças entre o positivismo jurídico defendido por Hart e a concepção normativa de direito defendida por Dworkin. Para tal empreendimento tratarei da relação entre o direito e a moral em ambos os autores. Também irei apontar para alguns pontos do debate que têm sido nos últimos anos fontes de muitas discussões em filosofia do direito, quais sejam, a distinção entre regras e princípios, empreendida por Dworkin, a discussão acerca da regra de reconhecimento e a crítica a Hart quanto ao poder discricionário no sentido forte. Palavras-chave: direito e moral; regras e princípios; a regra de reconhecimento; o poder discricionário.   Abstract: In this article I will examine the Hart's and Dworkin's concept of law.  I will try to show some differences between legal positivism defended by Hart and the normative conception of law advocated by Dworkin. With this purpose I will intend to address the relationship among law and morality in both writers. I will also point out some points of debate that in recent years have been source of much discussion in philosophy of law, namely, the distinction undertaken by Dworkin between rules and principles, the discussion about the rule of recognition and Dworkin's critique of the Hart's doctrine of power discretionary in the strong sense.   Keywords: law and moral; rules and principles; the rule of recognition; the discretionary power.   FONSECA, Tania S.
