A QUESTÃO DO ABORTO EM RONALD DWORKIN

Resumo

Este artigo busca problematizar a questão do aborto na obra do jus-filósofo Ronald Dworkin, tendo como alicerce a personificação dos agentes morais e do estado democrático de direito. Para isso, visualizaremos a obra Domínio da Vida, a partir daquilo trabalhado em Império do Direito: personificando indivíduos e sociedade para pré-rogar responsabilidade e direitos aos personagens da moralidade, podemos autorizar o aborto moral e juridicamente. Para isso, vamos inserir a complexidade com a qual Dworkin trabalha os conceitos de pessoa e sociedade. Observaremos ainda a tensão entre a autonomia da maternidade e os interesses dos estados americanos em proteger a vida humana e seu valor intrínseco. Só assim, nos de-bruçaremos sobre a concepção de sacralidade, admitida apenas do ponto de vista da inviolabi-lidade dos direitos individuais.Palavras-chave: aborto; igualitarismo-liberal; moralidade; constituição; tolerância.   Abstract: This article discusses the proposition of abortion in the work of Ronald Dworkin legal philosopher, having as basis the embodiment of moral agents and democratic state of law. For this, we going to analize the work Domínio da Vida, from what worked in the Império do Direito: impersonating individuals and society to give responsibility and rights to the characters of morality, we can authorize the abortion morally and legally. For this, we insert the complexity with which Dworkin works the concept of person and society. We still observed the tension between the autonomy of motherhood and the interests of american states to protect human life and its intrinsic value. Only then, turning to the concept of sacredness, admitted only from the standpoint of the inviolability of individual rights.   Keywords: abortion, liberal-egalitarianism; morality; constitution; tolerance.     MACIEL, Everton M.
