SOBRE A INTERPRETAÇÃO E A DISTINÇÃO “REGRAS E PRINCÍPIOS”: ELEMENTOS CONSTITUTIVOS DA FILOSOFIA DO DIREITO DE RONALD DWORKIN

Resumo

Neste estudo buscaremos evidenciar a distinção entre regras e princípios na teoria do Direito de Ronald Dworkin, bem como o processo de interpretação para os casos difíceis (hard cases). Para tanto, dividiremos este texto em três seções: na primeira seção, apontaremos duas críticas de Dworkin à teoria de Hart; para, a partir disso, apontar a sua proposta na segunda e terceira seções, onde abordaremos como o filósofo do direito entende que o juiz deva proceder para encontrar a melhor resposta, evidenciando, sobretudo, o processo de interpretação.Palavras-chave: regras; princípios; juiz; interpretação; casos difíceis.   Abstract This study will seek to highlight the distinction between rules and principles in legal theory of Ronald Dworkin, as well as, the interpretation process for hard cases. Accordingly, we divide the text into three sections: the first section, we consider two criticisms of Dworking´s theory Hart;  to with them point out  his proposal in the second and third sections, where we approach how the legal philosopher believes that the judge should proceed to find the best answer, showing especially the interpretation process.
