Non-Prosecution Agreement

A Solution for the Brazilian Criminal Justice System?

Abstract

This article aims to analyze the substantial change brought about by Law No. 13.964/2019, which introduced the non-prosecution agreement into the Brazilian Code of Criminal Procedure, in order to ascertain whether the ANPP can be an alternative to the overburdening of the criminal procedure system. Undoubtedly, it is an instrument that requires reflection and study by all legal professionals, as it has notably modified the way Criminal Procedural Law is applied in Brazil, demanding different approaches and strategies from those working in the field. Being a very recent mechanism in Brazilian criminal law, many points need answers and clarification in doctrine and case law. Therefore, this research proposes to present what the agreement consists of and, above all, the controversies surrounding this consensual mechanism, with the aim of verifying its suitability for the criminal system. To this end, the study used the bibliographic research method, with analysis of legal texts, doctrine, and judicial precedents.
